Acceptance of terms

By accessing or using Pace My Energy, you agree to these Terms and Conditions. If you do not agree, please do not use the service.

About the service

Pace My Energy is a wellness and self-management application designed to help individuals monitor daily energy, activity, and symptoms. It is operated by Pace My Energy LLC, a subsidiary of the Institute for Adaptive Health, L3C. The service is currently in beta. Features may change without notice.

Not medical advice

Pace My Energy is not a medical device and does not provide medical advice, diagnosis, or treatment. The pacing scores, energy metrics, and recommendations provided are for informational and self-management purposes only. Always consult a qualified healthcare provider before making changes to your health, activity, or treatment plan.

Eligibility

You must be at least 18 years old to use Pace My Energy. By using the service, you confirm that you meet this requirement.

Your account

You are responsible for maintaining the security of your account credentials. You agree to notify us immediately at info@pacemyenergy.com if you suspect unauthorized access to your account.

Subscriptions and billing

Paid plans are billed on a monthly or annual basis. Your 14-day free trial requires a valid payment method. You will not be charged until the trial ends. You may cancel at any time before the trial ends to avoid charges. Refunds are handled on a case-by-case basis. Contact us at info@pacemyenergy.com with any billing questions.

Your data

Your use of the service is also governed by our Privacy Policy. You retain ownership of your personal health data. We will never sell your electronic personal health information (ePHI). We may use de-identified, aggregated data in accordance with applicable law for product improvement, research, and business operations.

Intellectual property

All content, software, and design elements of Pace My Energy are the property of Pace My Energy LLC and Institute for Adaptive Health, L3C. The pacing methodology and underlying technology are patent pending. You may not reproduce, distribute, or create derivative works without written permission.

Prohibited uses

You agree not to use the service to:

• Violate any applicable law or regulation
• Submit false or misleading health information
• Attempt to reverse-engineer, scrape, or exploit the platform
• Interfere with or disrupt the security or integrity of the service

Limitation of liability

To the fullest extent permitted by law, Pace My Energy LLC and Institute for Adaptive Health, L3C shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Pace My Energy LLC, its officers, employees, and affiliates from any claims, damages, or expenses arising from your use of the service or violation of these terms.

Changes to these terms

We may update these terms at any time. We will notify you by email at least 30 days before material changes take effect. Continued use of the service after that date constitutes acceptance of the updated terms.

Governing law

These terms are governed by the laws of the State of Michigan, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Ingham County, Michigan.
